Release of Liability Waiver

Assumption of Risk, Waiver of Liability, and Release of Claims
PLEASE READ CAREFULLY BEFORE REGISTERING
In consideration of being permitted to participate in the disc golf tournament identified herein (the "Event"), I, the undersigned participant ("Participant"), do hereby freely, voluntarily, and without duress execute this Assumption of Risk, Waiver of Liability, and Release of Claims (this "Waiver") as follows:
1. Acknowledgment of Inherent Risks
Participant acknowledges and understands that participation in disc golf activities, including but not limited to practice rounds, competitive rounds, and all related Event activities, carries with it certain inherent risks, hazards, and dangers that cannot be eliminated regardless of the care taken to avoid them. Such risks include, but are not limited to: uneven or slippery terrain; exposure to weather conditions including heat, cold, lightning, and precipitation; impact by thrown discs or other objects; falls, collisions, and contact with natural or man-made obstacles; overexertion; and encounters with wildlife, insects, or environmental hazards. Participant further acknowledges that these inherent risks may result in serious bodily injury, permanent disability, paralysis, or death, as well as property damage or loss.
2. Assumption of Risk
Participant hereby expressly and voluntarily assumes all risks of participation in the Event, whether known or unknown, foreseeable or unforeseeable, including but not limited to the inherent risks described above and any risks arising from the negligence or omission of the Released Parties identified herein.
3. Release and Waiver of Liability
To the fullest extent permitted by applicable law, Participant hereby releases, waives, discharges, and covenants not to sue the following parties, together with their respective officers, directors, employees, agents, representatives, successors, and assigns (collectively, the "Released Parties"):
- (a) Hyzer HQ LLC and its officers, directors, employees, agents, representatives, successors, and assigns;
- (b) The Event organizer(s) and tournament director(s);
- (c) All Event staff, officials, marshals, and scorekeepers;
- (d) All Event volunteers, in any capacity;
- (e) All fellow competitors and participants;
- (f) All spectators and attendees;
- (g) The municipality, city, county, township, or other governmental entity or entities having jurisdiction over the Event venue, including all elected officials, employees, agents, and departments thereof;
- (h) The owners, operators, lessors, and lessees of the property or properties upon which the Event is conducted;
- (i) Any and all sponsors, vendors, and affiliated organizations; and
- (j) Any and all other persons or entities associated with the Event in any manner whatsoever.
Participant releases the foregoing Released Parties from any and all liability, claims, demands, causes of action, costs, and expenses of every kind and nature (including but not limited to attorney's fees), whether arising from negligence, gross negligence, or otherwise, that Participant may have or that may hereafter accrue, arising out of, connected with, or in any way related to Participant's involvement in the Event.
4. Indemnification
Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) incurred by any Released Party as a result of any claim brought by or on behalf of Participant or any third party arising out of Participant's participation in the Event.
5. Medical Authorization
Participant authorizes the Event organizer(s) and any medical personnel present to obtain or provide emergency medical treatment, transportation, and/or evacuation for Participant at Participant's sole cost and expense, should such treatment be deemed necessary in the judgment of the attending personnel.
6. Sole Responsibility
Participant affirms that Participant alone bears full and sole responsibility for any injury, illness, damage, loss, or death that may occur as a result of participation in the Event, and Participant accepts such responsibility unconditionally.
7. General Provisions
- (a) Severability. If any provision of this Waiver is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
- (b) Binding Effect. This Waiver shall be binding upon Participant and Participant's heirs, executors, administrators, personal representatives, and assigns.
- (c) Governing Law. This Waiver shall be governed by and construed in accordance with the laws of the state in which the Event is held, without regard to conflict of laws principles.
- (d) Entire Agreement. This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous understandings, whether written or oral.
- (e) Knowing and Voluntary Execution. Participant affirms that Participant has read this Waiver in its entirety, fully understands its terms and conditions, understands that Participant is giving up substantial legal rights by signing it, and has signed it freely and voluntarily without any inducement, assurance, or guarantee being made.
